1. Acceptance of Terms

By accessing or using Flappy Bird Free Coffee ("the Game"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Game. Your continued use of the Game after any changes to these Terms constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use the Game.
If you are between 13 and 18 years of age, a parent or legal guardian must review and accept these Terms on your behalf before you use the Game.
Purchasing tokens requires you to be of legal age to enter into binding contracts in your jurisdiction.
The Game is not directed at children under 13. We do not knowingly collect personal data from children under 13. If we become aware that a child under 13 has provided us personal data, we will delete it promptly.

3. User Accounts

You may register and log in via Facebook or a phone number (OTP verification).
You are solely responsible for all activity conducted under your account.
You must not share, sell, or transfer your account credentials to any other person.
We reserve the right to suspend or permanently ban any account that violates these Terms, at our sole discretion, with no obligation to refund unused tokens or points.
Banned accounts may submit a formal written appeal to admin@flappycoffee.com. We will review appeals in good faith but are not obligated to reinstate any account.
We may take the Game offline for maintenance at any time, with or without prior notice.

4. Virtual Tokens

Tokens are a virtual in-game currency. They have no monetary value and are not redeemable for cash or any real-world equivalent.
All token purchases are final and non-refundable, except where required by applicable law.
Tokens are non-transferable between accounts.
Tokens do not expire under normal circumstances; however, tokens in a banned or terminated account may be forfeited without compensation.
We reserve the right to change token prices at any time. Price changes do not affect tokens already purchased.
We may impose a maximum token balance per account at our discretion.
Each game session costs 1 token (or such amount as we may configure from time to time). We will provide reasonable notice of any change to the cost per game.

5. Payments

Payments are processed by Stripe (international payment cards) and ABA PayWay (KHQR). By making a purchase, you also agree to the applicable terms of service of the payment processor used.
All prices are displayed and charged in USD (US Dollars). We are not responsible for any currency conversion fees charged by your bank or card issuer.
Tokens are credited to your account only upon confirmation of successful payment. Failed, incomplete, or declined payments will not result in token credits.
ABA KHQR payment sessions expire within 5 minutes. If the session expires before payment is completed, no tokens will be credited and you must initiate a new transaction.
In the event of a payment dispute, chargeback, or fraudulent transaction, we reserve the right to immediately suspend your account and forfeit any tokens credited as a result of the disputed payment.

6. Game Points

Points are awarded after each completed game session based on your score.
Points have no monetary value and cannot be transferred, sold, or exchanged for cash.
We reserve the right to apply limits on daily points, minimum game duration, and anti-abuse cooldowns between sessions.
We reserve the right to adjust, reset, or expire points at our discretion, including in cases of suspected abuse or violation of these Terms.

7. Reward Vouchers

Reward vouchers ("Vouchers") are earned by redeeming accumulated game points at the applicable redemption rate.
Vouchers are valid for 30 days from the date of issuance and cannot be extended under any circumstances.
Vouchers are single-use only, have no cash value, and are non-transferable.
Points used for redemption are permanently deducted and cannot be reversed, regardless of whether the Voucher is redeemed or expires unused.
Voucher availability is subject to stock limits. We may suspend or discontinue any reward item at any time without notice.
We make commercially reasonable efforts to ensure that partner venues honor Vouchers, but we do not guarantee that any specific partner venue will be available, open, or willing to honor a Voucher at any given time.
We are not liable for any loss or inconvenience if a Voucher cannot be redeemed due to venue closure, system downtime, expiry, or any other circumstances beyond our reasonable control.

8. Prohibited Conduct

You agree not to engage in any of the following:

Using bots, scripts, macros, or any automated tools to play the Game, manipulate scores, or farm points/tokens.
Exploiting bugs, glitches, or vulnerabilities in the token, points, or voucher systems.
Creating multiple accounts to circumvent daily limits, game cooldowns, or account bans.
Selling, purchasing, or transferring accounts or virtual items for real money or other consideration outside the Game.
Reverse-engineering, decompiling, or attempting to extract the source code of the Game.
Interfering with the Game's servers, network infrastructure, or other users' gameplay experience.
Using the Game for any unlawful purpose or in violation of any applicable law or regulation.

Violation of any of the above may result in immediate account termination without refund.

9. Intellectual Property

The Flappy Bird game concept is based on the original game by Dong Nguyen / .GEARS. We operate as an independent derivative work and make no claim to the original trademark or brand.
All custom code, UI design, reward systems, and content created by us are our proprietary property.
By playing the Game, you grant us a non-exclusive, royalty-free, worldwide license to display your username and game scores on in-game leaderboards and promotional materials.

10. Disclaimers & Service Availability

The Game is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Game will be available, uninterrupted, error-free, or free of viruses or other harmful components.
Game scores, leaderboard data, and account balances may be lost or reset as a result of technical failures, and we are not liable for any such loss.
We are not responsible for any losses arising from service outages, payment gateway failures, third-party service interruptions, or data loss.

11. Limitation of Liability

To the maximum extent permitted by applicable law, our total cumulative liability to you for any claims arising out of or relating to your use of the Game shall not exceed the total amount you have paid us in the 30 days immediately preceding the claim.

In no event shall we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Game, your violation of these Terms, or your violation of any third party's rights.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Where changes are material, we will provide notice via an in-game message or by email (where available). Your continued use of the Game after changes become effective constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Game.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Cambodia, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved within 30 days of written notice, it shall be submitted to the exclusive jurisdiction of the competent courts of Phnom Penh, Cambodia.

2. How We Use Your Data

To create and manage your account.

3. Third-Party Services

We share your data with the following third-party services only to the extent necessary to operate the Game:

Firebase / Google — Authentication, cloud database (Firestore), and web hosting. Governed by the Google Privacy Policy.
Stripe — Card payment processing. We never store your card details. Governed by the Stripe Privacy Policy.
ABA Bank / PayWay — KHQR payment processing. Governed by ABA Bank's Privacy Policy.
Facebook / Meta — OAuth login. Governed by the Meta Privacy Policy.

We do not sell, rent, or trade your personal data to any third party for their own marketing purposes.

4. Data Retention

We retain your account data for as long as your account is active. If your account is terminated or banned, data may be retained for up to 2 years for fraud prevention and legal compliance purposes, after which it will be deleted or anonymized.

5. Your Rights

Subject to applicable law, you have the right to:

Request access to the personal data we hold about you.
Request correction of any inaccurate data.
Request deletion of your account and associated personal data (subject to legal retention obligations).
Withdraw consent for any data processing based on consent.

6. Security

We use industry-standard security measures including Firebase security rules, server-side identity token verification, and HTTPS encryption for all data in transit. No payment card data is stored by us — card processing is handled entirely by Stripe.

7. Cookies & Local Storage

The Game uses browser localStorage to remember your preferences (sound settings, bird color selection). We do not use any tracking cookies, advertising cookies, or third-party analytics cookies.

8. Children's Privacy

The Game is not directed at children under 13 years of age. We do not knowingly collect personal data from children under 13. If you believe we have inadvertently collected data from a child under 13, please contact us immediately and we will delete it.

9. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Material changes will be communicated via an in-game notice where possible.
